Your entitlement to breaks between shifts

In accordance with your award you are entitled to a break of ten hours from the time you finish a shift to the time you start the next shift, except where you have agreed in writing to an eight hour break.

You are under no obligation to agree to reduce the break from ten hours to eight hours.

If you have agreed to forfeit the ten hour break and then decide you wish to have the ten hour break re-instated you should notify your employer in writing of your decision to withdraw from the agreement and keep a copy of your notification.
