The Rules of the Queensland Nurses' Union of Employees and Professional Indemnity Insurance

1   Title

The name of the organisation shall be the “Queensland Nurses’ Union of Employees”.


2   Registered Office

The registered office of the Union shall be at Queensland Nurses’ Union of Employees Building, 187 Melbourne Street, West End, Brisbane 4101, or at such other place as the Council may decide from time to time.

Notice of any change of registered office shall be given to the Industrial Registrar within seven days of such change.


3  Interpretation

In these Rules unless there is something in the subject or context inconsistent therewith:–

(a) Words importing the singular number shall include the plural and words importing the plural number shall include the singular number.

(b) “Assistant Secretary” shall mean the Assistant Secretary of the Union.

(c) “Branch” shall mean a division of the Union within a district, town, hospital or institution as approved by Council pursuant to these Rules.

(d) “Branch election” means an election for an office referred to in sub-rule 43(g).

(e) “Consultative Committee Representative” shall mean a member, nominated by a Branch, to participate in the activities of any consultative body formed pursuant to an industrial instrument.

(f) “Council” shall mean the elected governing body of the Union.

(g) “Councillor” shall mean a member of the Council.

(h) “Enrolled Nurse” shall mean a person enrolled as such according to law who has completed a programme of basic enrolled nurse education and is qualified and authorised in Queensland to carry out nursing work complementary to and under the direction and supervision of registered nurses.

(i) “Federation” shall mean the Australian Nursing Federation, an organisation of employees registered pursuant to the Workplace Relations Act 1996 (Cwlth).

(j) “Financial” means having paid all monies due and payable under the Rules of the Union.

(k) “Financial Member” means a member who is not unfinancial as determined by Rule 16.

(l) “Health and Safety Representative” shall mean a member, nominated by a Branch, elected to the position of Health and Safety Representative pursuant to the Workplace Health and Safety Act 1995 (Qld).

(m) “Industrial Instrument” means an instrument defined as such in the Industrial Relations Act 1999.

(n) “Meeting of Delegates” means a meeting of Delegates to the Annual Conference convened by the Secretary in accordance with rule 45.

(o) “Nurses Registration Board of Queensland” shall mean its statutory successor the Queensland Nursing Council or any other statutory successor.

(p) “Officer” shall mean a person who holds an office in the Union or Branch within the meaning of that term in Sec.409 of the Industrial Relations Act 1999.

(q) “Official of the Union” shall mean a paid employee of the Union.

(r) “President” shall mean the President of the Union.

(s) “Queensland Nursing Council” shall mean the regulatory body for nursing established pursuant to the Nursing Act 1992 (Queensland).

(t) “Registered Nurse” shall mean a person registered as such according to law who has completed a programme of basic nursing education and is qualified and authorised in Australia to supply the most responsible service of a nursing nature for the promotion of health, the prevention of illness and the care of the sick. Basic nursing education is a planned educational programme which provides a broad and sound foundation for the effective practice of nursing and a basis for advanced nursing education.

(u) “Rules” shall mean these Rules and all supplementary, substituted or amended Rules for the time being in force.

(v) “Secretary” shall mean the Secretary of the Union.

(w) “Union” shall mean the “Queensland Nurses’ Union of Employees”.
