11 Misconduct of Members
If any member is charged by another member, in writing, with any of the following offences:–
(a) Acting detrimentally to the interests of the Union, or divulging confidential business to anyone not entitled to know it;
(b) refusing to obey any of the Rules of the Union; or refusing to comply with any orders authorised by the Council;
(c) defrauding or attempting to defraud the funds of the Union;
(d) making a false charge against a fellow member;
(e) violating or attempting to violate the terms of any industrial award or agreement;
(f) entering, or attempting to enter, into any agreement with any employer contrary to the provisions of any award or agreement secured by the Union and applicable to them;
the member so charged may be summoned to a special meeting of the Council to answer such charge, when they shall be permitted to cross-examine the member charging them, and to give an explanation with regard to the charge.
12 Expulsion and Suspension
A member charged with misconduct shall be given at least seven (7) days notice of the date of a special meeting of the Council at which the charge is to be considered, and of the charge made against them and be advised of the right to attend such meeting to cross‑examine the member or members bringing the charge, and make any explanation as they consider relevant in answering the charge.
If the member fails to attend the special meeting the charges may be dealt with in their absence.
The notice calling the special meeting shall include a notice of the intention of the Council to consider the charge.
If, after hearing the member making the charge, and the member against whom the charge is made, the Council is satisfied that the charge has been proved the member so charged may be suspended from membership for a period not exceeding twelve months, or be expelled from the Union.
Should the charge be proved frivolous, the person making such charge may be suspended from membership for a period not exceeding twelve months, or be expelled. A decision to suspend, or expel a member shall not be carried unless it is agreed upon by a two-thirds majority of the members of the Council present at such meeting.
The decision of such a meeting shall be final.
